1. The Shoot
1.1. On [shootDate] at [shootLocation], the Photographer photographed the Subject (the "Photographs"). Description: [shootDescription].
2. Grant of rights
2.1. In consideration of the sum of ££0 (which may be £0 where the Subject is a client), the Subject grants the Photographer a non-exclusive, worldwide, irrevocable licence for 10 years to use, reproduce, adapt, publish, and distribute the Photographs in any medium now known or hereafter devised, for the following purposes:
- Editorial use (news, articles, photographer's portfolio and exhibitions); - Online use (website, social media, blog);
2.2. The Photographer may make minor edits, retouching, and crop the Photographs for these uses without further approval. Material modifications (compositing, distortion, use in pornographic or defamatory context) require the Subject's separate written consent.
3. Photographer's IP
3.1. The Photographer remains the author and owner of the copyright in the Photographs (s.9 Copyright, Designs and Patents Act 1988). Nothing in this Release transfers ownership of the Photographs to the Subject.
3.2. The Subject may purchase prints from the Photographer separately. Personal use of supplied digital files (sharing on personal social media, printing for own home) is permitted at no extra cost.
4. Restrictions
4.1. The Photographs will not be used in connection with:
(a) defamatory, pornographic, or unlawful content; (b) advertising of products / services that the Subject has not specifically consented to.
5. UK GDPR — personal data
5.1. The Photographs include the Subject's image and are personal data under the UK GDPR.
5.2. The lawful basis for the Photographer's processing is consent (Article 6(1)(a) UK GDPR) given by signing this Release.
5.3. The Subject has the right to withdraw consent at any time by writing to the Photographer at [photographerEmail]. Withdrawal does not affect:
(a) uses already published before withdrawal; (b) any prints, copies, or backups already distributed.
5.4. The Photographer's full Privacy Policy is available on request.
6. No warranty by Subject
6.1. The Subject does not guarantee any particular outcome or commercial success from use of the Photographs.
7. Governing law
7.1. This Release is governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
