CHILDCARE / NANNY EMPLOYMENT AGREEMENT
This Agreement is made on [agreementDate] between:
(1) [employerName] of [employerAddress] (the "Employer"); and
(2) [nannyName] of [nannyAddress] (the "Employee" or "Nanny").
1. Position
1.1. The Employer engages the Nanny to provide childcare for [childrenDetails] (the "Children") at the Employer's home (the "Workplace").
1.2. The relationship is one of employer and employee. The Employer will register with HMRC, operate PAYE, and meet auto-enrolment pension obligations as required.
2. Start date and probation
2.1. Employment begins on [startDate].
2.2. The first 3 months are a probation period during which either party may terminate on 1 week's written notice.
3. Hours of work
3.1. The Nanny will work 40 hours per week, normally mon-fri.
3.2. Specific start/finish times to be agreed weekly; reasonable flexibility may be required for school pick-ups, appointments, etc.
3.3. Overtime (hours above 40/week) will be paid at the standard hourly rate, agreed in advance where possible.
4. Duties
4.1. The Nanny's duties include:
- safeguarding the welfare and safety of the Children at all times; - daily care: feeding, bathing, dressing, school runs, naps; - age-appropriate play, learning activities, outings; - preparing children's meals; - light tidying related to the Children (toys, laundry, lunchboxes) but NOT general household cleaning; - keeping a daily diary of the Children's activities, meals, sleep; - communicating any concerns about the Children to the Employer immediately.
4.2. The Nanny will follow the Employer's reasonable instructions on routine, diet, screen time, and discipline.
5. Salary
5.1. Gross salary: £[salaryAmount] per monthly period.
5.2. The Employer will deduct income tax and employee National Insurance contributions through PAYE and pay them to HMRC.
5.3. Payment is made by bank transfer on or before the last working day of each pay period.
5.4. Pension: the Employer will assess the Nanny for auto-enrolment under the Pensions Act 2008 and contribute to a qualifying pension if the Nanny meets the criteria.
6. Holidays
6.1. 28 days paid holiday per leave year (running with the calendar year, pro-rated for part-years).
6.2. This includes the eight UK bank holidays. If the Nanny works a bank holiday, equivalent time off will be given in lieu.
6.3. Holiday is to be agreed in advance with at least 4 weeks' notice except in emergencies.
7. Sickness
7.1. The Nanny will notify the Employer as early as possible on any day of sickness.
7.2. Statutory Sick Pay applies after the third consecutive day of absence, subject to the Nanny meeting earnings thresholds.
8. Confidentiality
8.1. The Nanny will keep confidential all family information and not disclose it to third parties (including on social media). This duty continues after the employment ends.
9. Background checks
9.1. The Nanny's employment is conditional on a satisfactory Enhanced DBS check. The Employer will reimburse the cost.
9.2. The Nanny confirms they are eligible to work in the United Kingdom and will provide right-to-work documentation.
10. Use of family vehicle
10.1. If the Employer's vehicle is used for childcare duties, the Employer will ensure insurance covers the Nanny as a named driver.
11. Termination
11.1. After the probation period, either party may terminate this Agreement on 4 weeks' written notice.
11.2. The Employer may terminate immediately for gross misconduct, gross negligence, fraud, or any conduct that endangers the Children.
12. Disciplinary and grievance
12.1. The Employer will follow the ACAS Code of Practice on Disciplinary and Grievance Procedures.
13. Governing law
13.1. This Agreement is governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction. Employment Tribunals retain jurisdiction over statutory employment claims.
